Report of the South African Ministerial Review Commission on Intelligence

In September 2008 the Ministerial Review Commission on Intelligence released its public report after a two-year review of intelligence legislation, policies, controls and institutional culture. The Commission was established in 2006 by the former Minister of Intelligence, Ronnie Kasrils. It comprises Joe Matthews (Chairperson), Dr Frene Ginwala and Laurie Nathan.
The report focuses on areas in which the intelligence dispensation is not aligned with the Constitution and identifies areas in which controls should be strengthened in order to prevent misconduct and abuse of power. The report makes proposals for addressing these issues and enhancing the effectiveness, efficiency and accountability of the intelligence services.
The Commission argues that there is insufficient debate on intelligence issues. This is not a healthy state of affairs in a democracy. Parliament, government and civil society groups should take steps to raise awareness and facilitate discussion on intelligence. The Commission`s report is intended to stimulate and contribute to this discussion.
