The Asset Forfeiture Unit - Making Crime Not Pay!

One of the objectives of The Prevention of Organised Crime Act (121 of 1998) is to combat organized crime, money laundering and criminal gang activity. The Act makes   provision for recovery of proceeds of unlawful activity; forfeiture of assets that have been used to commit an offence or assets that are proceeds of unlawful activity. In short, the Act seeks to ensure that crime does not pay in that, where appropriate, people who participate in organised crime do not only get prosecuted but also forfeit assets gained through their criminal activities.

 

In recent years, the Asset Forfeiture Unit (AFU) of the National Prosecuting Authority has shown its willingness and determination to operationalise the provisions of The Prevention of Organised Crime Act.  This has resulted in a number of court cases.

 

Realising the need to reflect on the successes and setbacks encountered by the AFU in fulfilling this mandate and lessons learned in the process, the ISS will be hosting a seminar as follows:

 

Speaker: Mr Willie Hofmeyer, the head of the AFU in the NPA. Mr Hofmeyer will deal with the legal issues relating to the POCA and give an overview of how the AFU has been conducting itself in the light of seemingly conflicting judgements.
